| 摘 要： | 文学创作要符合生活的真实,但同时创作者还必须把握好真实性的法律维度,以免因读者“误读”而导致侵权。而法院在面对此类案件时又必须审慎立案,避免被“读者”身份所同化,从而影响法官的中立裁判。
