WTO与金融服务业的国际化问题研究

就《服务贸易总协定》下的金融服务业开放问题而言,WTO相关法律仅仅提出了服务贸易自由化的义务和标准,即按照相关WTO规则和中国加入世贸组织承诺为标准的自由化。因而,金融服务业的国际化实际上是通过金融服务贸易逐步自由化过程实现的。自由化是一个终极目标,也是一个相对概念。所以,中国金融服务业作为一个整体必须学会援用《服务贸易总协定》基本原则和中国加入世贸组织时的金融市场准入具体承诺,最大限度地保护自己按照WTO协议所应当享受的合法利益,以减少和缓解国际化所造成的不合理的经济冲击和利益冲突。

On WTO and the Internationalization of Financial Service

In the respect of the opening up of financial service according to the General Agreement of Service Trade,the relevant laws of WTO only formulate the obligations and criteria of the service trade freedom,that is,the freedom based on the WTO rules and the promise of China when entering WTO.The internationalization of financial service is realized through the free financial service trade.The liberalization is the target and the relevant concept as well.Therefore,it is advisable that China financial service trade as a whole body learn to protect its legitimate rights and interests on the basis of the fundamental principles of the General Agreement of Service Trade and the specific promises on the admission of financial market,so as to reduce and relieve the economic conflicts and interest collisions caused by the internationalization.
