| Abstract: | Based on the analysis of the basic concepts and the elements of the merchandising right of fictional characters, The article discussed the existing legal protection on them and the existence limitation, and made recommendation. It will have the important role in the merchandising right of fictional characters＇ reality protection and the independent right＇s establishment in future. |
