| 摘 要： | 法治是一种源远流长的意识形态、治国方略和社会文化现象。以“依法治国”为出发点和归宿的当代法律文化是人类文化的一种具体形态,是先进文化在法治领域中的集中体现。先进文化从本质上讲应是“权利文化”,其根本内涵在于“以人为本”。对这一全新命题的探讨应从文化学、法律史学、宪法学、法理学等多个角度展开。只有坚持“以人为本”,才能促进先进文化的健康发展。

| Abstract: | The rule of law is a kind of consciousness and social cultural phenomenon. The contemporary law culture is a kind of mankind culture, it is an embody of the advanced culture in the law realm. Int the author's opinion,the advanced culture should be the right culture. This new topic should be dissertated in law history,constitution law,jurisprudence and other aspects. Only by insisting to"making people the center"can the advanced culture be developed healthily. |
