设立自然资源物权之初探

自然资源物权的建立是经济发展、社会进步的结果,虽然这些权利具有一定的特殊性,但究其根源,并不影响它们的物权属性。自然资源物权是符合物权法理论及其发展方向的。传统的物权法分类完全可以将其涵盖其中。自然资源物权并不是独立于自物权和他物权以外的新概念,而只是按客体的不同做出的新分类。笔者认为自然资源物权体系是自然资源所有权、自然资源用益物权以及自然资源担保物权的综合体。

On Constitution of Real Right of Natural Resources

The constitution of Real Right of Natural Resources is a result of the development of society and economy.Although the rights have something unusual,they are always Real Right.Actually,the Real Right of Natural Resources accords with the theory of Real Right and the development of it.The Real Right of Natural Resources could be classified to the traditional sorts of Real Right entirely.Real Right of Natural Resources is not the new concept which is a counterpoint of jus in re proprin and jus in re aliena,but a new classification according to the different objects.The author believes that the system of Real Right of Natural Resources is a synthesis of ownership of natural resources,usufructuary right of natural resources and security interest of natural resources.
