司法腐败与社会失控——以南京国民政府后期为个案的分析

南京国民政府后期(主要指1946年至1949年),司法腐败与政治腐败如影相随,司法腐败源于政治腐败,并加剧政治腐败;司法腐败引起民众法律信仰危机,致使社会秩序难以维系,民心丧失殆尽,加速了政治失控,进而导致社会失控。前车之鉴,后事之师。通过对南京国民政府时期司法腐败加剧社会失控的关系分析,值得我们反思的不仅仅是如何防治司法腐败的问题,更多的应该是先进的司法体系应该附属于什么样的政治体制,政治体制需要什么样的社会土壤,才能杜绝司法腐败,使司法体制真正发挥作用等问题。

Jurisdiction Corruption and Losing Control of the Society——Taking Nanjing National Government in the Later Ruling Period as a Case

During the late part of its ruling (1946-1949), Nanjing national government was plagued by jurisdiction and political corruption. The former is originated from the latter and deteriorate the latter in turn. The jurisdiction corruption leads to the credit crisis about law in the mass, the difficulty of sustaining social order, losing the belief of the public, accelerating the losing political control, even social control. Former history should be a mirror for the future. Through this analysis, we should reflect how to prevent jurisdiction corruption, more importantly, what kind of political system the advanced jurisdiction system should be attached to, what're the social requirements of the politic system in order to prevent jurisdiction corruption.
