| 摘 要： | 刑事评议程序的合理建构,对于保障刑事裁判的公正性有着极其重要的意义。我国刑事诉讼立法没有对刑 事评议程序作出详尽的规定,导致实践中存在诸多问题,程序适用的随意性极大。因此,刑事评议程序的建构和完 善势在必行,而其路径主要在于明确刑事裁判的一系列具体规则。

| Abstract: | Rational construction of criminal evaluation procedure is of great significance to the righteousness of criminal judgment. Elaborate regulations of the criminal evaluation procedure are lacking in the code of criminal procedure in China, which gives rise to a number of problems in practice and hence arbitrariness. Therefore, the construction and perfection of criminal evaluation procedure is inevitable and its way-outs lie in defining in detail a series of specific regulations about criminal judgment. |
