论专业人士的咨询责任

具有专业知识的咨询服务人员在提供了错误的咨询意见并致他人损失时,应当承担相应的民事责任。该责任应属于侵权法的调整范围,在当事人之间存在咨询合同关系时,合同法也可用于解决咨询责任的问题。咨询责任应采过错责任原则,其执业过错的判断应以一个具有通常专业技能的咨询专家在相同情势下应具有的技术水平和注意程度来衡量;咨询责任的赔偿范围包括纯经济损失、机会丧失以及特定情形下的精神损害。

On Professional Consultant's Liability

When a professional consultant gives wrong information or ideas which result in loses,he should take tort liability or contractual liability.The liability of consultant should be esteblished on his fault.The consultant's fault must be measured by the standard consultant practice,in the same or similar communities.At the time the consultant was performing his services,the extent of compensation consists of pure economic loss,loss of chance and mental compensation.
