| 摘 要： | 从事实角度而言,过失的心理构造无法容留意志要素;从规范的角度而言,意志要素既无法说明过失行为的不法性,也不能说明过失行为的有责性。因此,在应当预见的前提下,过失的成立要素在于＂没有预见＂,无需意志要素的存在。

| Abstract: | From the factual point of view,the fault can not shelter the will in it's psychological structure;from the normative point of view,the will element can not account for the lawlessness nor the responsibility of a negligent act.Therefore,based on the foreseeable obligations the establishment of elements of negligence is not anticipate,without the will-element. |
