复行为犯既遂形态研究

复行为犯是刑法明文规定的,在一个独立的犯罪构成中包含两个或两个以上不独立成罪的、异质的、具有手段与目的关系的实行行为的要素行为的一种犯罪形态。根据既遂标准的不同,可以将复行为犯区分为行为犯型复行为犯和结果犯型复行为犯两种形式。基于犯罪客体对犯罪既遂判断所起到的决定性作用,应以目的行为的完成作为行为犯型复行为犯成立既遂的标志,以目的行为完成后法定犯罪结果的发生作为结果犯型复行为犯成立既遂的标志。

Research on Accomplishment of Plural Act Offense

Plural act offense refers to a criminal pattern which is regulated by the criminal law definitely and consists of two or more independent and foreign elements of act with the relationship of means and purpose . Plural act offense can be divided into the of- fense of act type and consequential offense type according to the different standards of accomplishment of a crime. Based on the crimi- nal object of crime which plays a decisive role in deciding on accomplishment of a crime, the offense of act type should be marked as the completion of objective behavior , and consequential offense type should be marked as the completion of the legal consequences af- ter objective behavior.
