| 摘 要： | 理论及司法实务界对"未成年人犯罪不适用累犯"应如何认定仍存在争议。在宽严相济刑事政策背景下,应对"不满十八周岁的人犯罪不构成累犯"作缩小解释,同时应在刑事责任年龄外根据不同的犯罪类型对未成年人是否适用累犯作进一步区分,以更好地预防未成年人犯罪。

| Abstract: | Because of the difterent standpoints about the judicial determination of juvenile recidivist. In the context of criminal policy of combining punishment with leniency, a restrictive interpretation should be given to the opinions that the minors can exclude the application of recidivist system under any conditions. It can be set on the basis of different types of crimes. All of this will contrib- ute to the prevention and reduction of Juvenile Delinquency. |
