试论对作者发表权的认定——从一起发表权的侵权纠纷案认定引起

“发表权”系作者的精神权利,是作者决定作品是否公之于众的权利。但发表权一旦经作者行使,他人未经作者同意而实施的对其作品利用的行为,是否仍构成对作者发表权的侵犯呢?本文试从一起案例出发,结合我国现行《著作权法》的有关规定来探讨发表权的内涵,侵犯作者发表权的构成要件和责任认定,以期对作者发表权的认定有一个全面的理解与把握。

On the Identification of the Right of Publication

The right of publication is one of the moral rights of an author. It is about the determination of the author, whether his work is published or not. Is anyone still infringe the right of publication, if he use the work without the license of the author after the author has first exercised the right of publication? This article will discuss according to the newly amended < the Copyright Law of China > the questions that arise from a case, such as, the identification of the contents, the infringement and infringement liability of the right of publication, in order to get a complete comprehension of this right.
