In the era of information and internet, e-commerce will become the major form of commerce. At the same time, net commercial arbitration will become the most potential and brightest form to settle e-commerce disputes. Net commercial arbitration is based upon net arbitral agreement which, compared with traditional arbitral agreement, features very different form essentials. Taking defining the possible scope of e-commerce as its precondition, the paper inquires into written form, e-signature and evidence validity of form essentials of net arbitral agreement and suggests a preliminary solution to tackle the problem.
