行政检查的概念在学理研究和实定法上以多种面相出现,厘清这一概念尤为必要.文章梳理了日本、韩国、英美、我国台湾地区有关行政检查的概念,重点探讨了我国学理研究和实定法上有关行政检查的概念,并总结了行政检查含义的演变趋势.排除行政调查中纯粹的资料搜集行为,行政检查等同于行政调查,是指行政主体对行政相对人是否遵守国家的法律、法规、规章的情况,作单方面强制了解的行政行为

On the Concept of Administrative Inspection:in Perspectives of Doctrines and Provisions of the Law

The concept of administrative inspection appears in different faces in theoretical researches and regulations,so to clarify this concept is particularly necessary.With a review of the concept in Japan,South Korea,Britain,the United States and China’s Taiwan,this article makes a study of the concept in perspectives of the theoretical studies and related provisions of the law in China and summarizes the evolution trend of the concept.It concludes that except for information-gathering behavior,administrative inspection is equivalent to administrative investigation in that administrative inspection is the administrative act that the administrative body takes on the administrative counterpart with respect to the compliance of laws,regulations or rules.
