审查逮捕工作的现状及改进

检察机关降低逮捕率已初见成效,但捕后案件中未获徒刑判决的仍占较高比例。客观来看,逮捕质量不高的案件是由于把关不严、法律法规及证据发生变化以及认识分歧等多种因素造成的,但检察机关审查逮捕标准的偏离、追诉犯罪对保障权利的挤压、证据审查模式的陈旧以及逮捕替代补充措施的缺位也是不争的事实。检察机关要严格遵循逮捕法定条件、更新工作理念、完善配套措施,进一步提高审查逮捕工作水平。

Present Situation and Improvement on Arrest Examination

The efforts to reduce the arrest rate has achieved initial success,but the number after arrest cases without substantial punishment decision of prison still occupy a higher proportion. Objectively speaking,the quality of the arrests is due to many factors,such as the evidence change and differences between the reviews. But the deviation from arrest requirements,the contempt for the protection of the rights,the old evidence review mode and the absence of alternative measures to arrest are also indisputable facts. Prosecutors should,strictly follow the arrest requirements,update the concepts,improve the supporting measures,to further improve the level of arrest examination.
