| 摘 要： | 环境保护行政合同通常具有时间跨度大、涉及面广等特性,在此期间,如发生导致双方权利义务关系发生重大变化的事由,变更或者解除制度是平衡当事人之间权利义务的必要工具。在相关制度安排与设计中,既要注意并尊重环境保护行政合同与民事合同相关制度的共性,更要关注两者个性所带来的影响并做出相应的安排。

| Abstract: | Administrative contract about environment protection usually has a larger span of time,involving a wide range of issues.During this contract period,if major changes occur to the relation between rights and obligations of both parties,it is necessary to alter or dissolve the contract to regain the balance.Appropriate arrangements and design should be made to the alternation and dissolution to respect and protect the universality of related systems of administrative contracts and civil contracts.More concerns should be showed to the individuality of the two contract system. |
