死刑存废的理论根据及其评价

刑法学界在死刑问题上早就形成了存、废两派,但至今两派在论辩中难分胜负。废除派难以回答为什么被害人不可剥夺的生命却被杀人犯剥夺了;也难以回答杀人犯违背了不剥夺他人生命的义务,其自己的生命为什么不可剥夺。保留派用报应理念为死刑辩护已经不合时宜,从遏制力上又拿不出死刑遏制犯罪的实证资料。尽管如此,但我们仍然倾向于废除死刑。并认为,还可补充几点废除死刑的理由:死刑会成为罪行更严重的人毁灭罪证的手段;死刑会成为一派政治力量镇压另一派政治力量的手段;废除死刑可以树立善的榜样;废除死刑能从整体上减少“人为地剥夺生命”的不人道行为。

The Theorical Foundation of the Existing & Abolishing on the Death Penalty and Its Appraisal

We prefer abolishing death penalty. Them are lots of reasons for abolishing death penalty, for examples, the death penahy couht become the measure that the criminal destroyed the evidence of crime; death penalty could becomc the measure, that one political power suppresses the other; abolishing death penalty could set example of virtuous; abolishing the death penalty could reduce the impotent action.
