论社会信用立法

信用缺失已严重影响了我国社会主义市场经济建设的进行,从经济发展的需要和社会信用的现状出发,必须进行社会信用立法。在立法形式上,应进行统一立法;在立法方法上,应进行分散立法和补充立法;在立法内容上,应着眼于建立企业信用制度,确立失信惩罚机制,制定政府信用条例等,与此同时,还应正确处理诚信立法与民商事立法的关系,以及政府职能转变与信用立法的关系。

On the Legislation Relevant to Social Credit

The absence of credit has enormously affected the buildup of China's socialist market economy.Hence,viewed from the necessity of economic development and from the status quo of social credit,laws relevant to social credit must be brought about.However,as to the mode of legislation,a unified legislation procedure should be adopted;as to the method of legislation,different laws should be passed respectively;and as to the contents of legislation,stresses should be laid on the establishment of the enterprise credit system and the mechanism of punishment,and the laying-down of the regulations of governmental credit.Besides,the relationship between legislations relevant to credit and those to civil or commercial affairs,the relationship between the changes of governmental functions and legislations relevant to credit should be dealt with properly.
