| 摘 要： | 集体合同应当体现协约自治的精神,这是集体合同制度行之有效的前提和保证。但在我国,集体合同自治精神无法得以彰显,主要归因于工会的自由度和独立性受到限制,以及工人缺乏罢工权作为推进集体谈判的保障。

| Abstract: | Autonomy should be embodied in the collective agreement,which is the precondition and guarantee of the effectiveness of the collective agreement system.But in China,the spirit of autonomy is deficient,which is attributed to such factors as the limitation of the freedom and independence of our trade unions,and lack of the worker's right to strike. |
