宪法学范畴的逻辑研究

宪法学范畴是宪法学理论体系的架构.宪法学范畴有其自身的逻辑结构与层次,本文将宪法学范畴的逻辑结构分为基石范畴、基本范畴、一般范畴这三个层次.每个层次的范畴成为宪法学体系的支柱和支点,为宪法学研究奠定了基础,将复杂的宪法现象以合理科学的逻辑结构联系起来,共同形成了宪法学这张宏大的网.宪法学的基石范畴是人权,基本范畴包括权力与权利,宪法与宪政两对对应范畴,一般范畴由基本范畴分解而来或直接间接派生,在稳定的基础上有较强的开放性,本文基于这三个逻辑层次对宪法学范畴进行整体把握.

The Logic of Constitutional Category

Constitutional category is the framework of constitutional law theory system and has its own logic structure and level. In this paper, its logic structure is divided into three levels： the foot -stone category, basic category and general category. Each level is the pillar and support system of constitutional jurisprudence, and lays foundation for the research on constitutional law. Besides, they relate the complex constitutional phenomena by reasonable and scientific logic structure, thus a grand network of constitution forms. The foot - stone category of constitutional law is human rights; the basic category consists of two corresponding categories： power and rights, constitution and constitutionalism. And the general category is decomposed or derived directly or indirectly from the basic one, and has strong stability - based openness. By these three levels, this paper makes an overall discussion of constitutional category.
