An Analysis of the Ancient Mediation System in China

The traditional mediation system in China has had its philosophical and social roots.Originating from the ancient Chinese legal culture without litigation,the mediation system reflects the ideal of ancient Chinese rulers of setting up a harmonious society.In feudal China,the mediation system fit in with the patriarchal clan system and also served as an important approach for the implementation of the rulers' political ideal of "moral government complemented by penalty".Therefore over 2000 years of Chinese history,the mediation system has been a stabilizing factor for social relationships,but it has also been an obstacle that hinders the progress and development of Chinese society.As a phenomenon of traditional Chinese legal culture,the mediation system has had important influence on the construction of modern mediation system in our country.
