| 摘 要： | 随着我国市场经济的发展，著作权与商标权以及外观设计的冲突越来越突出，如何解决这一冲突已成为知识产权界的重要话题。本文从冲突形成的原因以及现有的冲突解决途径着手进行分析，最后提出自己关于解决该冲突的建议。
