论证券监管法律制度的基本原则

笔者认为，证券法律制度的基本原则可以区分为两个不同层面的原则；一是，调整证券市场平等主体之间证券财产关系的民法属性的证券法基本原则；二是，调整证券市场非平等主体之间监管与被监管关系的经济法属性的证券法基本原则，后者即为本文所论述的证券监管法律制度的基本原则，它具体包括：公开、公正、适应、高效和政府集中统一监管与行业自律监管有机结合以及分业经营与分数不清监管等六项基本原则。

Fundamental principles of Security Supervision Legal System

This paper argues that there are two levels of meaning about the fundamental principles of security legal system: first, it contains civil law attributes; second, it contains economic law attributes. This paper focuses on the economic law attributes, including openness, justice, appropriateness, efficiency, etc.
