| 摘 要： | 随着互联网的飞速发展,各种网络犯罪活动也如影随形,日益狡猾猖獗,已成为一个严重的社会问题,也使得网络犯罪的法律规制成为各国的焦点之一。鉴于此,笔者立足刑法的视角再论网络犯罪的法律遏制一文,从探析网络犯罪概念角度,考虑如何充分发挥网络给人们社会生产、生活等带来极大便利,同时将网络犯罪带来的负面效应减小到最低限度做出新的思考。
