| 摘 要： | 我国刑事诉讼法对举证责任的规定很简略,理论上也少有针对性的探究,司法实践中标准不明,随意性大。文章根据我国的立法规定和司法解释,结合外国立法和举证责任分配的基本原理,探讨公诉案件审判程序中举证责任的具体分配问题,以期对司法实践有所裨益。

| Abstract: | Rules of liability to give evidence in Chinese criminal action law are simple,concerned standards in judicable practice are obscure and desultory.Based on legislation and judicial interpretation,combining foreign legislation and basic distribution principles of liability to give evidence,Chinese specific distribution formulae in public indictment cases are explored in this article,which is expected to offer some practical consultation. |
