| 摘 要： | 我国旅游市场导游私拿回扣、索要小费问题根源于旅行社和导游之间利益分配关系的扭曲。从法律角度看,导游私拿回扣属于商业贿赂行为,而索要小费则违反了当事人意思自治的法律原则。解决导游私拿回扣、索要小费问题的关键是要建立合理的导游报酬机制,按照社会主义市场运行规则,找出合理的方式,调整各方利益关系。

| Abstract: | In our travel market now,tour guides' quest for commission and tips is rooted in the distortion of the benefit relationship between the tour guides and the travel agency.From the legal point of view,tour guides' quest for commission and tips is a kind of business bribery,and their asking for tips violates the lex principle of the party's volition.The key to solve the problem is to construct a rational tour guide pay system so as to find an appropriate way to adjust the two parties' benefit relationship according the principle of socialist market economy. |
