| 摘 要： | 在我国，由于《婚姻登记条例》在制定时只注重了对离婚登记程序的简化而忽视了相关配套措施的设立，因此在实施过程中出现了被滥用的情况。本文通过对国外协议离婚的介绍、对我国协议离婚立法历程的回顾，在此基础上，分析了我国协议离婚制度的缺失及导致这种缺失的原因，并提出了完善的立法对策。
