| 摘 要： | 近代中国社会转型与法制现代化存在着明显的互动关系,一方面,社会转型对法制现代化的产生和发展起着决定性的作用;另一方面,法制现代化对社会转型也起着一定的推动作用.在这一互动进程中,晚清至民初法制现代化经历了启蒙期、发生期和徘徊期三个阶段,具有明显的历史特征.
