我国农民权利缺失与制度保障研究

农民权利的有效保护是解决"三农"问题的根本途径。目前,我国农民在政治参与权、土地财产权、受教育权、社会保障权等方面的保障不足。农民权利缺位的根源在于歧视性的城乡二元结构体制、宪法和法律保护的缺位、农民法定的维权组织缺乏以及农民维权意识与能力不强。为了真正保障农民权利,政府需要改革以户籍制度为核心的城乡二元结构体制,强化对农民权利的法律保护,建立农民的维权组织,培育农民的权利意识。

Research on the Deficiency and Institutional Guarantee for Farmers’Rights in China

The effective protecting the rights of farmers is a fundamental way to solve the problems concerning agriculture,countryside and farmers.At present,the rights protection for farmers is inadequate in political participation,real property,education,social security and other aspects.The deficiency of farmers’ rights originates from the discriminatory dual structure of urban and rural areas,the absence of constitutional and legal protection,lack of statutory farmer rights keeping organizations and their poor consciousness and capacity of rights safeguarding.In order to efficiently protect farmers’ rights,the government needs to reform the urban-rural dual structure with household registration system as the core,strengthen the legal protection of farmers’ rights,establish farmer rights keeping organizations and cultivate their right consciousness.
