| 摘 要： | <秋菊打官司>是一个已有诸多阐释的经典文本,但仍有进一步解读的空间.影片中,秋菊被一股"气"裹胁着到处上访讨"说法";而村长则因"面子"而拒绝道歉.这背后是村庄生活的在地逻辑.村民以"面子"为纽带构成一种特定的"权利"和"义务"关系;违反"权利"和"义务"相平衡的规则,会导致"气"的产生;"气"积累到一定程度,"面子"就可能被撕破.对此,基层国家机关表现出理解的态度,而高层国家机关则更加关注法治的运作.
