货物买卖法律制度的国际趋同化

国际货物买卖法律制度主要由国际贸易公约、国际贸易惯例以及各国国内贸易立法共同组织成。考察各类贸易法律制度,不难看出,国际货物贸易法律制度呈现出趋同化。在国际经济一体化进程中,协调和统一国际货物买卖法律制度是有必要和可能的。我国货物贸易法律制度也应当逐步完善并与国际货物贸易法律制度协调和统一。

Unification and Harmonization of International Trade Law on Sale of Goods

Research on unification and harmonization of international commercial law on sale of goods is very important, for it is promoting international trade development. International trade treaties, international commercial customs and domestic laws are all involved into system of international trade law. There are many similarities which exist in contents on formation of contracts, right and obligation between parties whose places of the business are in different states, and on methods of controlling imports and exports of international trade for sale goods. After comparing several institutions of law from different countries, the result shows that to unify and harmonize international trade law is necessary and possible to the growth of international economic interdependence among countries.
