| 摘 要： | 在研究方法上,环境权的属性是一种理论假设,其构成了深入研究环境权体系的起点和基础,而现有的研究大多忽略了这一点。将环境权定位为一项基本人权是目前认可度最高、也最为合理的假设,但依照体系建构的要求,其还必须解决自身的普遍性和正当性问题。以习惯权利为基础区分环境权的应然和实然层面,可为环境权的基本人权属性提供更加充分的论证,也是进一步探究环境权体系的起点和基础。
