| 摘 要： | 建设工程承包人的优先受偿权是传统民法中优先权的一种 ,它对于保护建设工程承包人的合法权益 ,降低建设工程承包人的经营风险 ,促进建筑市场的稳定与发展 ,起着十分重要的作用。本文从优先受偿权的性质、行使的前提及时间、受偿位序、财产范围及实现方式等方面 ,对建设工程承包人的优先受偿权进行了论述。

| Abstract: | The repayment priority of architectural project contractors is one of the traditional priorities in the civil law. It is of great importance to protect the contractors' legal rights, to lessen the contractors' operating risk, and to promote the stability and development of architecture market. This article relates the features, conditions and time of fulfillment, procedures of repayment, scope of property and ways of implementation. |
