| 摘 要： | 侵犯著作权犯罪包括侵犯著作权罪和销售侵权复制品罪两个具体犯罪,两罪侵犯的客体系复杂客体,侵犯著作权犯罪的具体行为多样,其中的出版行为和制作行为有特定的含义,刑法第217条规定构成该罪的复制和发行、制作和出售行为应该分别同时具备.

| Abstract: | The Crime of Infringement of Copyright includes two specific crimes: the crime of infringement of copyright and the crime of sale and duplication. The object the two crimes carry belongs to the complex object. The specific criminal acts of the crime of infringement of copyright are various among which the publication act and production act have special implications. Article 217 of the criminal law regulates the crime constitutes the acts of duplication, issuing and sale meanwhile. |
