| 摘 要： | 19世纪的美国处于社会转型时期,其司法界面临着传统主义与实用主义的两难选择.著名法官卡多佐作为实用主义的推崇者,凭借他的司法智慧和天才,在其任职期间"静悄悄地"完成了普通法的革命.卡多佐在其著作<司法过程的性质>中所蕴涵的法律哲学思想和司法理念,其分析和解决法律乃至社会问题的思维角度和方法,对我国的司法体制建设有借鉴作用.

| Abstract: | In the 19th Century,American judicial system was caught in a fix between traditionalism and pragmatism as the society was undergoing changes.Benjamin N.Cardozo,a celebrated judge and a foregoer of pragmatism,realized the quite revolution of common law thanks to his judicial wisdom and genius.The paper mainly introduces juristic philosophy and judicial conception in in Cardozo's The Nature of the Judicial Process,so that we can learn from his thinking and approaches that he used to analyze and solve the judicial and social issues,and serve the judicial system of China. |
