| Abstract: | In those criminal cases where the identity of the victim's death is unknown,the civil compensation can't be achieved.How to confirm the right subject is still in a blank in our legislation.On this premise,improving the present legal system is the way to protect the legitimate rights of interested parties and discharge of liability.This paper,starting from the actual case, around the prepaid compensation issue,analyzes the application of law and evaluates the handling of the people's courts,then puts forward proposals to explore the nature of the problem. |
