Farming civilization in China,where agriculture plays a main role in economy,leads to the oriental features of traditional law which embody ethicalization,politicization,unbalance between rights and duties,lawsuitless tradition.Thus the construction of Chinese legality follows the changes of farming civilization and it fails because of political legislation from above,double-structure of civil and rural economy and thick farming tradition.Rural problem has become an obstacle which urges the comprehensive consideration of Chinese legality,citilization of rural area,construction of rural enterprises and rural economic reform.
