| 摘 要： | 中国古代酷刑大体可分为讯刑与法定刑两种。由于法外施刑的大量存在，刑罚之残酷是人类历史上罕见的。株连之法的适用使得一人犯重罪往往同时祸及其妻子儿女、三族、九族的亲人甚至是朋友、邻居。统治者利用酷刑来达到惩罚、恐吓、确认皇权的无上权威甚至是娱乐的目的，酷刑对中国人社会生活、社会心理有久远影响，公民权利意识的觉醒对摆脱酷刑文化的影响、促使中国走向法治化社会有重要影响。
