| 摘 要： | 医患纠纷中,患者常以其知情同意权被侵犯为由,要求损害赔偿。因此,在医疗过程中,医患双方必须对知情同意权及其构成要件有个正确理解,同时,医方又要尊重患者的知情同意权,加强医患之间的沟通,只有如此,医患双方才能正确行使或履行知情同意权。对患者知情同意权构成要件进行分析与梳理,不仅具有理论意义而且具有实践意义。

| Abstract: | Nowadays,patients often claim damages based on their informed consent.Thereby,during the med-ical behaviors,doctors should respect the patients' informed consent and enhance the communication with them.On the other hand,doctors should adhere to the regulations and rules to protect themselves.This paper analyzed the informed consent and pointed out that it should be carried out before medical treatment. |
