从SARS看我国公共危机管理法制建设

针对我国在SARS防治过程中暴露出的一系列法律问题,如公共危机管理法律体系不健全、公共危机管理行政法律主体缺位、行政紧急权力的行使缺乏法律依据、非职权性行政主体在公共危机管理中的法律地位不明确等,提出了制定《公共危机管理基本法》,健全公共危机管理法律体系,依法确立公共危机管理的法律主体,制定《政务信息公开法》,明确非职权性行政主体法律地位等完善公共危机管理的法律对策。

Legal Institutions for Public Crisis Administration in View of SARS

Analyzes a series of legal problems exposed in the process of epidemic prevention/controlling of SARS, such as the imperfect legal system of public crisis administration, absence of administrative authorities concerning public crisis, lack of legal foundation to execute administrative power in emergency and uncertain legal status of unauthorized departments. Then, the following legal countermeasures are put forward against the problems exposed, including to formulate the "Basic Law on the Administration of Public Crisis" and "Law on Making Government Public", to make certain the authorities for public crisis by law and to provide a definite legal status to the unauthorized departments.
