宪法学与公法学的关系——从立法政策学看公法学的制度价值

以传统意义上的公法作为法学的研究对象，仅仅在立法政策学的意义上是可行的。对公法问题的研究可以帮助立法机关进行科学的立法规划和建立起系统化的立法体系，但前提是必须以宪法作为立法机关享有立法职权的法律依据，因此，宪法作为根本法，本身是公法的理论和制度前提，它既包括了公法的正当性，又涉及到私法的正当性．基于宪法与公法的不同法律特性，宪法学应当尽量地以解决实际生活中出现的宪法问题为主线，尽量减少宪法学自身的抽象性，避免使宪法学的范畴与公法学的范畴相混淆。

The Relationship between Chinese Constitutional Law and the Public Law

As the investigation object of the law science,the traditional public law is only feasible in the legislative policy study.The investigation of the public law can help the legislative body to formulate scientific legislative regulations and systematically to establish the legislative system,but the premise should be taking the constitution as the lawful basis of the legislative authority for the legislative organization.Thus,as an essential law,the constitution itself is the premise of the theory and system of the public law,which both includes the validity of the public law and involves the validity of the private law.Owing to the different law characteristics between the constitution and the public law,the constitutional science should at first take as the main line the settlement of the constitutional problems in the real life,and reduce to the greatest extent the Abstractness of the constitution itself in order to avoid the confusion between the category of the constitutional science and that of the public law science.
