| 摘 要： | 法制现代化的模式是指各国在法制现代化的过程中,由于历史文化背景、动力机制以及在处理和解决由传统向现代发展过程中的各种复杂的矛盾关系时的价值选择不同,因而形成不同的发展范型。从不同的视角来看,法国法制现代化具有典型的先发特征,是内发型、传统变异型、个人权利本位型、形式合理与价值合理并重发展型统一的法制现代化模式。

| Abstract: | The legal system modernization pattern refers to the various countries in the legal system modernization process.Because of the different history cultural contexts,the power mechanism and value choice in processing and the solution of complex contradictory relations,there forms different development patterns.From different angles of view,the French legal system modernization is characteristic of generation,the modernization pattern of legal system united with the inner-generation,the traditional variation,the individual right standard,equal attention to reasonable form and reasonable value. |
