我国《化学物质控制法》之立法展望——兼论欧盟之经验

目前,我国的化学物质立法缺乏一部基本立法,在国际贸易自由化和环境问题全球化的今天,已经不能适应促进我国化学物质国际贸易和国际环境保护的需要,必须予以关注。我国《化学物质控制法》应当借鉴欧盟的立法经验,以有毒有害的现有化学物质和新化学物质为主要的调整对象,以化学物质的安全、环境风险预防和控制为主要的规范领域。只有这样,才能体现其立法价值。

Legislative Prospect of P. R. China Act on Control of Chemicals——Also on European Experience

Now China lacks a basic chemicals act.In the era of freedom of international trade and the globalization of environmental problems,this phenomenon is not suited to the demands of Chinese international chemicals trade and international environmental protection.So we should pay enough attention to the legislation of this field.P.R.China Act on Control of Chemicals should select the existing poisonous or hazardous chemicals and new chemicals as its regulatory objects.And it should make the regulation mainly on the safety risk and environmental risk of these chemicals.Only by taking this orientation can the legislative value of this legislation be embodied clearly.
