| 摘 要： | 文章运用刑法理论,从界定国际犯罪的内涵出发,阐释了国际法上海盗犯罪的行为特征。为有效行使国际公约所规定的对海盗行为的普遍管辖权,从法律价值层面上分析了制裁海盗犯罪国内立法的必要性及其内在合理性。在此基础上,认为我国刑法应当与国际刑法全面衔接,并提出应根据我国已经缔结或者参加的国际条约中所规定的国际罪行,在刑法分则中增设新罪名,建立一个完整的惩治国际犯罪的国内法律体系。
