区块链电子证据的研究与思考

区块链技术与电子证据的结合是区块链技术的法律化应用又一创新,最高人民法院通过司法解释认可了区块链电子证据的合法性。区块链电子证据产生的目的是通过区块链技术补足电子证据一些先天性弱点,但不论从电子证据的证据资格认定还是电子证据在司法实践中经常不予采纳的理由,区块链电子证据的优势并不明确。过分的推崇工具的先进性而忽略司法实践中的问题,无益于法律与技术的相互结合。区块链电子证据存证作为一种法律工具,应当理性回归其工具价值。

Research and Reflection on Blockchain Electronic Evidence

The combination of blockchain technology and electronic evidence is another innovation in the legal application of blockchain technology,and the Supreme People’s Court has recognized the legitimacy of blockchain electronic evidence through judicial interpretations.The purpose of blockchain electronic evidence generation is to complement some of the congenital weaknesses of electronic evidence through blockchain technology,but the advantages of blockchain electronic evidence are not clear in terms of the identification of electronic evidence and the reasons why electronic evidence is often rejected in judicial practice.It is not beneficial to combine law and technology by over-extolling the advancement of the tool and ignoring the problems in judicial practice.As a legal tool,blockchain electronic evidence certificate should rationally revert to its tool value.
