| 摘 要： | 通过对中国宗法社会的考察 ,讨论了传统宗法伦理及其对法律制度、法律程序和法律意识的影响 ,认为宗法政治伦理使传统政治、法律关系及其观念陷入道德化和非道德化二难境地。宗法经济伦理严重冲击着司法程序的建立 ,宗法士人伦理制约着“理性—形式化”的法律意识和法律精神的形成 ,而氏族和宗庙则对法律起着抗衡的消极影响。市场经济要求法律制度的保障并呼唤着现代法律体系的建立 ,但市场经济也存在着制约和瓦解法律精神的因素。

| Abstract: | Based on a close investigation of the Chinese patriarchal society, the paper has discussed the patriarchal ethics and its influence on China's legal system, legal procedure and legal awareness, concluding that patriarchal political ethics has brought the tradition Chinese politics, its legal relationships and concepts into an awkward dilemma between moralizing and non moralizing, and that patriarchal ethics is fatally detrimental to the establishment of a healthy legal procedure and the awareness of a rational formalist legal system. Market economy requires the protection from a legal society and calls out for the establishment of such a system, and meanwhile there is in the market economy something that holds back and does damage to the legal spirit. |
