| 摘 要： | 本文认为我国国家追偿程序立法内容的稀缺状况 ,不利于监督国家赔偿义务机关在代表国家向受害人履行国家赔偿义务后 ,对法定的追偿对象正确有效地行使追偿权。因此 ,建立与完善国家追偿程序是十分必要和重要的。有识于此 ,本文提出了建立国家追偿的决定程序、救济程序、执行程序和督促程序的构想。

| Abstract: | The present author holds that the lack of a legal procedure of state debt reclamation in China is detrimental to the right of the state authorities acting on behalf of the creditor to reclaim the debts for him and thus it is vitally urgent to establish and promote a legal procedure of state debt reclamation. The article is a brief statement of the author's suggestions on the establishment of the decisive procedure, the complementary procedure, the executive procedure and the supervision procedure of state debt reclamation. |
