| 摘 要： | 国家所有权制度是物权法中的一项重要制度 ,由于国家主体所具有的特殊性 ,国家所有权也体现出不同于物权的特殊之处。从经济学的假定及观点出发对国家所有权主体的经济人及政治人特性、国家所有权客体的效用实现、国家所有权保护中对外部侵害与内部控制的防范等问题的研究 ,表明国家所有权的制度设置应采取民商法与经济法并重的模式

The study of state ownership economic man and political man the subject, the effect realization of state ownership the object, as well as the protection of state ownership against external invasion and internal control reveals that the establishment of state ownership regulations should adopt the joint mode of civil commercial and economic laws. |
