奥古斯丁原罪论与荀子性恶论的犯罪之维

摘    要:中世纪奥古斯丁依其宗教神学观提出原罪论,并以此来说明人为什么会犯罪;中国古代的荀子依其唯物观及对人类自身的认识主张性恶论,认为人之所以为善是后天教育的结果。原罪论、性恶论从不同视角阐释了犯罪产生的根源及本质、犯罪的原因及防范控制。

Abstract:The crime is one of the very complicated social phenomena,which comes into being with the emergence of human society.In the Middle Ages,Augustine proposed the theory of original sin in accordance with the theological theory,based upon which he elaborated the cause of crime and the punishment;In ancient times,a famous Chinese scholar named Xunzi proposed that human nature is evil in the light of materialism and the self-recognization of human being,and maintained that the reason why people do benevolent deeds is the result of nurture.From different perspectives,both of the theories expounded the root cause and the essence of crime,coupled with the prevention and control of crime.
