| 摘 要： | 近二、三十年来 ,各国立法开始从对仲裁加以限制与严格监督向鼓励与支持仲裁转变。其中一个方面就是仲裁条款的效力向第三人延伸。仲裁条款对第三人的效力 ,是指第三人享受仲裁条款中规定的权利以及承担条款赋予的义务。本文对仲裁条款对第三人效力在涉及实质本人、代理或受托转让、合并分立、继承以及关联方与关联协议时的情形作了简要的分析。

| Abstract: | In the last tens of yaers,there has been a trend in states' legislature from imposing constraint and strictly supervise upon to supporting the arbitration.One aspects of this trend is the extending of effects of arbitration clauses to third parties.What is the effects of arbitration clauses on the third party is that the third party could enjoy the right or bear the obligation provided by the clause.The article would give a concise analysis on the effect of a arbitration clause on the third party when concering real principals,agent or trustee,assignee,consolidation,heritage and related parties or related agreements. |
